The Supreme Court of India emphasized the right to a pollution-free environment in a ruling regarding the use of firecrackers in Delhi. On November 11, 2024, the bench, comprising Justices Abhay S Oka and AG Masih, stated that "๐ฏ๐ฐ ๐ณ๐ฆ๐ญ๐ช๐จ๐ช๐ฐ๐ฏ ๐ฆ๐ฏ๐ค๐ฐ๐ถ๐ณ๐ข๐จ๐ฆ๐ด ๐ข๐ฏ๐บ ๐ข๐ค๐ต๐ช๐ท๐ช๐ต๐บ ๐ธ๐ฉ๐ช๐ค๐ฉ ๐ค๐ณ๐ฆ๐ข๐ต๐ฆ๐ด ๐ฑ๐ฐ๐ญ๐ญ๐ถ๐ต๐ช๐ฐ๐ฏ," highlighting that burning firecrackers adversely affects citizens' fundamental right to health as protected by Article 21 of the Constitution.
The Court's remarks followed its earlier inquiry into the enforcement of a firecracker ban imposed by the Delhi government on October 14. Reports indicated that air quality in the National Capital Region had deteriorated significantly post-Diwali. The bench expressed dissatisfaction with how the ban was enforced, noting that it was not taken seriously by the Delhi Police.
The Court directed the Commissioner of Police to immediately inform all firecracker license holders to cease sales and distribution within Delhi. Additionally, it mandated the establishment of a special cell to ensure compliance with the ban year-round and held local police station heads accountable for enforcement.
The Delhi government indicated that it would consult stakeholders regarding a potential extension of the ban beyond Diwali, with a decision expected by November 25. The Court also called upon neighboring NCR states to respond regarding their policies on firecracker manufacture, storage, sale, and use.
