All Private Property Cannot be Acquired by the Government: Supreme COurt

𝗔𝗹𝗹 𝗽𝗿𝗶𝘃𝗮𝘁𝗲 𝗽𝗿𝗼𝗽𝗲𝗿𝘁𝘆 𝗰𝗮𝗻𝗻𝗼𝘁 𝗯𝗲 𝗮𝗰𝗾𝘂𝗶𝗿𝗲𝗱 𝗯𝘆 𝘁𝗵𝗲 𝗴𝗼𝘃𝗲𝗿𝗻𝗺𝗲𝗻𝘁: 𝗦𝘂𝗽𝗿𝗲𝗺𝗲 𝗖𝗼𝘂𝗿𝘁

The recent Supreme Court ruling in 𝘗𝘳𝘰𝘱𝘦𝘳𝘵𝘺 𝘖𝘸𝘯𝘦𝘳𝘴 𝘈𝘴𝘴𝘰𝘤𝘪𝘢𝘵𝘪𝘰𝘯𝘴 & 𝘖𝘳𝘴. 𝘷𝘴. 𝘵𝘩𝘦 𝘚𝘵𝘢𝘵𝘦 𝘰𝘧 𝘔𝘢𝘩𝘢𝘳𝘢𝘴𝘩𝘵𝘳𝘢 has significant implications for property rights in India, particularly regarding the interpretation of Article 39(b) of the Constitution. The court, with a majority of 8:1, determined that not all private properties qualify as "material resources of the community" that the state can acquire for public good.

𝗞𝗲𝘆 𝗙𝗶𝗻𝗱𝗶𝗻𝗴𝘀 𝗼𝗳 𝘁𝗵𝗲 𝗥𝘂𝗹𝗶𝗻𝗴

𝗣𝗿𝗶𝘃𝗮𝘁𝗲 𝗣𝗿𝗼𝗽𝗲𝗿𝘁𝘆 𝗮𝗻𝗱 𝗖𝗼𝗺𝗺𝘂𝗻𝗶𝘁𝘆 𝗥𝗲𝘀𝗼𝘂𝗿𝗰𝗲𝘀: The court clarified that while some private properties may be considered material resources if they serve the community, not all privately-owned properties fall under this category. This marks a departure from earlier interpretations that broadly included private resources as community assets.

𝗩𝗮𝗹𝗶𝗱𝗶𝘁𝘆 𝗼𝗳 𝗔𝗿𝘁𝗶𝗰𝗹𝗲 𝟯𝟭𝗖: The court upheld the validity of Article 31C, which protects laws made under Articles 39(b) and (c) from being challenged on certain grounds, even after the striking down of Section 4 of the 42nd Amendment in the Minerva Mills case. This means that laws aimed at redistributing resources for common good retain their constitutional backing.

𝗠𝗮𝗷𝗼𝗿𝗶𝘁𝘆 𝗮𝗻𝗱 𝗗𝗶𝘀𝘀𝗲𝗻𝘁𝗶𝗻𝗴 𝗢𝗽𝗶𝗻𝗶𝗼𝗻𝘀: The majority opinion, authored by Chief Justice D.Y. Chandrachud, emphasized that an expansive interpretation allowing blanket state acquisition of private property could undermine individual property rights and discourage investment. Conversely, Justice Sudhanshu Dhulia dissented completely, arguing for a broader interpretation that would include more private properties as community resources.
